What is Permaclips?

Permaclips is a powerful, secure and totally free iOS app designed to protect and preserve your video evidence in real-time. With Permaclips, users can safely record videos from their iPhones that are automatically and continuously uploaded in secure, 60-second segments directly to their own Google Drive accounts.

 

How Permaclips Works:

 

-Real-Time Remote Backup: As you record a video, Permaclips uploads your footage securely and continuously to your personal Google Drive in 60-second clips. This immediate upload ensures that even if your phone is damaged, lost, or confiscated, your recorded evidence remains safely preserved online.

-Secure Cloud Storage: Permaclips uploads your videos exclusively to your own Google Drive account. Your data is private and secure, protected by Google's robust security measures, and only accessible to you.

-Automatic Resumable Uploads: The app leverages Google's secure resumable upload functionality to handle connectivity interruptions gracefully. If your connection is interrupted during an upload, Permaclips will automatically resume uploading your footage once connectivity is restored, ensuring no critical video segments are lost.

-Full User Control: You maintain complete ownership and control of your recordings. Permaclips never stores or accesses your footage on third-party servers. Your videos go directly from your device to your Google Drive.

Thank you for choosing PermaClips (“the App”). PermaClips is developed and operated by Perma Evidence SA, a company based in Costa Rica (hereinafter referred to as “we,” “us,” or “our”). Your privacy is important to us. This Privacy Policy explains how we collect, use, and protect information when you use our App.

1. Introduction

 

PermaClips allows you to record videos and upload them directly to your Google Drive. We do not store any personal information or videos on our servers because we do not have any servers or databases associated with this App. All data related to video uploads, user authentication, and access tokens is processed directly with Google.

 

By using PermaClips, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use our App.

2. Information We Do Not Collect

1. No Personal Information Storage

• We do not collect or store your name, email address, or any other personal data in our systems.

• We do not maintain any user database or server that could store user data.

2. No Video Storage

• The videos you record are stored locally on your device or uploaded to your personal Google Drive account. We do not have access to your videos once they are on Google Drive.

3. No Server-Side Logging

• Since we do not operate our own servers, we do not log any usage data or personal information.

3. Permissions and Local Device Storage

1. Camera and Microphone Access

• The App requests access to your device’s camera and microphone solely to enable video recording. We do not collect or transmit any data related to the camera or microphone usage to our servers (since we have none).

2. Local Storage

• Videos recorded through the App may be temporarily stored in your device’s local storage (Documents or Caches directory) while they are being processed or segmented. Once the upload to Google Drive is complete, segments may be removed from the local storage.

• You have full control over your local video files, and you may delete them at any time.

3. Photos Library Access (Optional)

• The App may request access to your Photos library to save the final, higher-quality video for your own records. We do not upload your Photos library data to any third-party servers.

4. Google Sign-In and Drive Integration

1. Google Sign-In

• PermaClips uses Google Sign-In to authenticate users who wish to upload videos to their Google Drive.

• The App obtains an access token from Google, which is stored temporarily on your device to facilitate uploads. We do not store or manage this token on any server.

2. Google Drive Upload

• When you record a video, the App directly uploads the video to your Google Drive account. The upload is handled by Google’s APIs.

• We do not retain any copy of your videos.

• All interactions with Google Drive are governed by Google’s Terms of Service and Privacy Policy. We strongly recommend you review Google’s Privacy Policy for detailed information on how they handle your data.

5. Third-Party Services

 

The only third-party service the App uses is Google (for authentication and file storage). We encourage you to review Google’s policies:

We do not share any user information with other third-party services or partners.

6. Children’s Privacy

 

PermaClips is not intended for use by anyone under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information within our App, please contact us immediately at permevidence@gmail.com.

7. Security

 

Although we do not collect or store personal information on our servers, we take reasonable measures to protect the information you process in the App locally on your device. Please note:

• Local Security: We rely on your device’s operating system security features (passcodes, biometric authentication, etc.) to keep your device and data secure.

• Network Security: All uploads to Google Drive occur over secure (HTTPS) connections managed by Google.

Welcome to PermaClips (“the App”), provided by Perma Evidence SA (“we,” “us,” or “our”). By accessing or using the App, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must refrain from using the App.

1. Acceptance of Terms

 

1.1 Binding Agreement

By downloading, installing, or using PermaClips, you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy (collectively referred to as the “Agreement”).

 

1.2 Age Requirements

You must be at least 13 years of age to use the App. If you are under 18 (or the age of majority in your jurisdiction), you must have the permission of a parent or legal guardian to use the App, and your parent or legal guardian must agree to these Terms on your behalf.

2. Description of the Service

 

2.1 PermaClips Functionality

PermaClips allows you to record video segments on your device and upload them directly to your Google Drive account. We do not store or have access to your videos after they are uploaded to Google Drive.

 

2.2 Third-Party Integration

The App integrates with certain Google APIs for sign-in and video uploading. Your use of Google services is governed by Google’s own terms of service and privacy policy. We are not responsible for Google’s practices, performance, or any third-party actions.

3. “As Is” Disclaimer and No Warranties

 

3.1 App Provided “As Is”

PERMA EVIDENCE SA PROVIDES THE APP “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OR GUARANTEES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY.

 

3.2 No Responsibility for Recording Issues

We make no representations or warranties about the reliability, quality, or accuracy of video recording or uploading. If for any reason the recording process fails or the video does not upload properly, we bear no responsibility.

 

3.3 Third-Party Services

We do not guarantee the uninterrupted or error-free functionality of third-party services (such as Google Drive). Any interactions you have with Google services are solely between you and Google.

4. Limitation of Liability

 

4.1 No Liability for Damages

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, PERMA EVIDENCE SA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF PERMA EVIDENCE SA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

4.2 Maximum Liability

IN NO EVENT SHALL PERMA EVIDENCE SA’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THIS AGREEMENT EXCEED THE AMOUNT PAID BY YOU (IF ANY) TO USE THE APP.

 

4.3 User Content and Backup Responsibility

You are solely responsible for backing up any videos or content. We are not responsible for the preservation of any user-generated content, including recorded videos, on your device or in your cloud storage.

5. User Obligations

 

5.1 Lawful Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the App does not violate any applicable law or regulation.

 

5.2 Device and Internet Requirements

You are responsible for obtaining and maintaining compatible devices and internet connections to use the App. We are not liable for any interruptions, delays, or failures resulting from inadequate device specifications or internet connectivity.

 

5.3 Account Security

When using Google Sign-In or any other authentication method, you are solely responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.

6. Intellectual Property

 

6.1 Ownership

All intellectual property rights in and to the App, including but not limited to its name, logos, and code, are owned by or licensed to Perma Evidence SA. Nothing in these Terms grants you any ownership right in the App or its content.

 

6.2 Restrictions

You may not reverse engineer, decompile, modify, or create derivative works of the App or any part thereof without our explicit written permission.

7. Modifications and Termination

 

7.1 Changes to the Terms

We reserve the right to modify or update these Terms at any time by posting a new version on or through the App. Your continued use of the App after any such modifications constitutes your acceptance of the updated Terms.

 

7.2 App Updates and Discontinuation

We may modify, update, or discontinue the App or any of its features at any time without notice or liability to you.

 

7.3 Termination by You

You may stop using the App at any time by uninstalling it from your device.

 

7.4 Termination by Us

We reserve the right to terminate or suspend your access to the App at any time if we believe you have violated these Terms or for any other reason, without prior notice or liability.

8. Governing Law and Dispute Resolution

 

8.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Costa Rica, without regard to its conflict-of-law provisions.

 

8.2 Dispute Resolution

Any dispute arising out of or related to these Terms shall be brought exclusively in the courts located in Costa Rica, and you consent to the personal jurisdiction of such courts.
